The biggest crypto bill in Washington is stuck — and the industry is moving on without it. On September 15, 2026, the Senate failed to invoke cloture on the motion to proceed to the Digital Asset Market Clarity Act (H.R. 3633): 49 votes in favor, 50 against, eleven short of the 60 needed to open debate. The House had passed the bill 294-134 back in July 2025, and the Senate Banking Committee advanced it 15-9 in May — but on the floor, it died.
On October 20, Senator Cynthia Lummis renewed her criticism of Democrats over the Senate draft's exchange provisions — which would have required digital commodity exchanges to file annual financial statements certified by an independent auditor with the CFTC and keep five years of complete audit-trail records. The bill is technically still eligible for a return — Senator Tillis filed a motion to reconsider — but no new vote is scheduled, and prediction markets put passage by the end of 2026 at around 7%.
The SEC proposed crypto custody rules on October 1 and cleared a tokenized-stock exemption on September 17. Crypto M&A hit a record $9.7 billion in disclosed deal value in the first half of 2026. And the GENIUS Act — the separate stablecoin law signed July 18, 2025 — takes effect no later than January 18, 2027, reserves and disclosures and all.
The pattern is unmistakable: the market-structure bill failed, but market structure is being built anyway — by agencies, by deal flow, and by builders shipping non-custodial tools that sidestep the custody question entirely.
Much of the regulatory fight is about custody — who holds your coins, and what rules protect you when they do. Nova Exchange and NovaSwap are non-custodial by design: your funds never leave your wallet, so there's nothing to seize, freeze, or mismanage. Regulation will shape the industry's future, but custody risk is one risk you can remove today.
